1. Acceptance
By using this website you agree to these terms. If you do not agree, please do not use the site.
2. Website Purpose
This website presents David & Dayton Media’s services, historical campaign work, and tools for starting a conversation about customer acquisition. It is informational; nothing on it is an offer capable of acceptance without a separate written agreement.
3. Marketing Services
David & Dayton Media provides marketing services including paid advertising management, creative production, conversion funnels, and lead systems. Descriptions on this site are general; actual scope is defined per engagement.
4. Separate Client Agreements
All client engagements are governed by separate written agreements. In any conflict between this website and a signed agreement, the signed agreement controls.
5. No Guarantee of Results
Marketing outcomes depend on factors outside any agency’s full control. Nothing on this website guarantees leads, appointments, customers, revenue, cost per lead, or any other outcome.
6. Historical Results
Performance metrics identified as actual results represent historical performance from the particular campaign, client, and reporting period identified.
Past performance does not guarantee future performance.
Results may vary based on market conditions, competition, advertising spend, service, offer, creative, sales process, follow-up, seasonality, platform behavior, and other circumstances.
7. Demonstration Data
Where interface mock-ups or demonstration content appear, they are presentations of how information is displayed and are not historical results unless expressly identified as actual campaign data. Concept campaigns in the work library are strategy examples and claim no performance.
8. Case Studies
Case studies describe specific historical engagements. Client identities may be withheld or anonymized. Case studies are illustrations of approach, not promises of comparable outcomes.
9. Calculators
Calculator outputs (including the ROI calculator and campaign builder) are illustrative, based solely on the numbers you enter and transparent rules, and are not projections, advice, or guarantees of performance.
10. Promotional Offers
The first-month $0-management-fee offer is subject to availability, scope, eligibility, and a written agreement. Advertising spend and third-party costs are separate and are the client’s responsibility.
11. Advertising Spend
Advertising budgets are paid to the advertising platforms and are separate from any David & Dayton Media fees. Historical budgets shown on this site represent specific historical snapshots and are not a recommended budget for any business.
12. Third-Party Platforms
Advertising runs on platforms (such as Meta and Google) governed by their own terms, policies, and behavior. We are not responsible for platform availability, policy changes, or account actions taken by platforms.
13. Intellectual Property
The content of this website — text, design, and original creative — belongs to David & Dayton Media or its licensors. You may not reproduce it for commercial purposes without permission.
14. Third-Party Marks
Meta, Facebook, Instagram, Google, and other marks are the property of their respective owners. Their use here is descriptive and implies no endorsement or affiliation.
15. User Submissions
Information you submit through forms must be accurate and yours to share. You are responsible for the content of free-text submissions. Our use of submitted information is described in the Privacy Policy.
16. Website Availability
The site is provided “as is” and may be modified, interrupted, or discontinued at any time without notice.

Links to third-party websites are provided for convenience; we do not control and are not responsible for their content or practices.
18. Screenshots
Advertising-platform screenshots may be cropped, resized, anonymized, or incorporated into visual presentations for readability, provided that the underlying represented performance metrics are not intentionally altered.
19. Attribution
Where transaction volume, pipeline value, revenue, or similar business outcomes are referenced, David & Dayton Media describes the metric according to the information available.
Advertising may contribute to business outcomes without necessarily being the sole cause of such outcomes.
20. Legal Limitations
