DRAFT — PENDING ATTORNEY REVIEW. This policy was prepared for David & Dayton Media and has not yet been reviewed or approved by legal counsel. Do not treat it as final legal language until that review is complete.
1. Who We Are
David & Dayton Media (“we,” “us”) is a customer-acquisition agency based in Los Angeles, California. This policy describes how we handle information collected through this website.
2. Information You Provide
When you submit a form on this site — a strategy-call request, a growth-audit request, a campaign-builder brief, or a call-prep note — you may provide your name, business name, website, industry, location, business economics (such as average customer value and marketing spend), phone number, email address, preferred meeting time, and free-text descriptions of your situation.
3. Automatically Collected Information
Depending on your cookie choices, we and our service providers may automatically collect device and usage information such as IP address, browser type, pages viewed, referring URLs, and campaign parameters (for example UTM tags) attached to the link you arrived from.
4. Sources of Information
We collect information directly from you (forms, calls, emails), automatically from your device (subject to your consent choices), and from advertising and analytics platforms that report on the performance of our own marketing.
5. How We Use Information
We use information to respond to your inquiries, prepare for and schedule strategy conversations, review the marketing materials you ask us to audit, provide and improve our services, measure the performance of this website and our own advertising, and comply with legal obligations.
6. Advertising & Analytics
With your consent, we use analytics tools (such as Google Analytics via Google Tag Manager) to understand how the site is used, and advertising tools to measure whether our own marketing works. These tools are loaded only after you opt in through the cookie banner.
8. Meta Pixel / Conversions API
With your advertising consent, the Meta Pixel may collect event data (such as page views and form submissions) to measure our advertising on Meta platforms, and we may transmit similar event data server-side through the Meta Conversions API. Meta’s use of this data is governed by Meta’s own terms and policies.
9. Google Technologies
With your consent, Google Tag Manager, Google Analytics 4, and Google Ads conversion tracking may set cookies and process usage data to measure site performance and our own advertising on Google platforms, governed by Google’s terms and policies.
10. Third-Party Providers
We use service providers to operate this website — for example hosting, scheduling (when a booking calendar is embedded), and customer-relationship tools that receive your form submissions so we can respond. Providers receive only what they need to perform their function.
12. Sale / Sharing Disclosure
Under some privacy laws, allowing advertising platforms to collect data via cookies can be considered “sharing” for cross-context behavioral advertising. Because optional advertising cookies are off by default here, such sharing occurs only if you opt in — and you can withdraw that choice at any time via Cookie Preferences.
13. California Privacy Rights
If you are a California resident, you may have rights under the CCPA/CPRA, including the right to know, correct, and delete personal information, the right to opt out of sale or sharing, and the right not to be discriminated against for exercising those rights. Exercise them using the contact details in section 23 or via Cookie Preferences for cookie-based sharing.
14. Privacy Requests
To make a privacy request — access, correction, deletion, or opt-out — email nick@daviddaytonmedia.com or call (818) 524-8784. We may need to verify your identity before acting on a request.
15. Data Retention
We keep information for as long as needed for the purposes above — typically for the duration of our communication or engagement with you plus a reasonable period — unless a longer period is required by law or a shorter one is requested and feasible.
16. Security
We use reasonable technical and organizational measures to protect information — including transport encryption, input validation, and redaction of contact details in operational logs. No method of transmission or storage is completely secure.
17. Marketing Email
If you receive marketing email from us, you can opt out at any time using the unsubscribe mechanism in the message or by contacting us directly.
18. SMS & Telephone
By submitting a form with your phone number and checking the consent box, you agree that we may contact you about your inquiry by phone or SMS. Reply STOP to end SMS contact; message and data rates may apply.
19. Children's Privacy
This website is a business-to-business service and is not directed to children under 13 (or under the age required by applicable law). We do not knowingly collect personal information from children.
20. External Links
Links to third-party sites (including scheduling and social platforms) are governed by those sites’ own privacy policies.
21. Campaign Data & Case Studies
David & Dayton Media may display campaign results, advertisements, screenshots, performance metrics, case studies, and examples of marketing work when authorized or otherwise permitted.
Where appropriate, identifying client information may be withheld, blurred, anonymized, or aggregated.
David & Dayton Media does not intentionally publish consumer lead contact information — including names, telephone numbers, email addresses, or similar personal information — in public portfolio materials.
22. Policy Changes
We may update this policy from time to time. The “Last updated” date above reflects the current version; material changes will be posted on this page.
